When a person is unable to manage his or her own care or finances due to a mental disability or because the person is a minor, it may become necessary to ask the court to appoint a guardian (over the person) and/or a conservator (over the property). Through the guardianship or conservatorship process, the probate court will grant powers to a designated person who will be responsible for making decisions and acting in the best interest of the disabled person. The disabled person is known as the ward. The court-appointed person is known as the guardian for the person or the conservator for the property. The guardian or conservator is accountable to the court for acting in the ward’s best interest.
